State law requires specific strategies to ensure all students eat breakfast.

Code of State Rules 126-85-16. Bus Schedule

16.1. The school and transportation schedules must provide time for school breakfast prior to the start of the student'sinstructional day.

16.2. A minimum of ten minutes eating time (after going through the serving line) is to be provided for students eatingschool breakfast.

Code of State Rules 126-86-13. Feed to Achieve - Innovative Breakfast Delivery Strategies

13.1 All West Virginia public schools are required to collaborate with the OCN to develop strategies and methods to increase the percentage of students participating in the school breakfast and lunch nutrition programs and adopt a delivery system approved by the OCN to ensure that all students are given an opportunity to eat breakfast.These approved systems shall include, but are not limited to: Grab-and-Go Breakfasts, Breakfast in the Classroom, or Breakfast After First Period.

West Virginia Code 18-5D-3. School nutrition programs.

(c) Each county board of education shall:

  • (1) Require all schools to adopt a delivery system approved by the state Office of Child Nutrition, no later than the 2015 school year, that ensures all students are given an adequate opportunity to eat breakfast. These approved systems shall include, but are not limited to, Grab-And-Go Breakfasts, Breakfast in the Classroom or Breakfast After First Period; and

  • (2) Collaborate with the state Office of Child Nutrition to develop strategies and methods to increase the percentage of children participating in the school breakfast and lunch nutrition programs.
