(2) Students first entering grade nine in 1985 and thereafter, but prior to the 2001-2002 school year, shall have earned at least 18½ units of credit or their equivalent, as determined by the commissioner, in order to receive either a Regents or local high school diploma. Such units of credit shall include:

  • (vi) health education, one-half unit of credit in accordance with the requirements set forth in section 135.3(c) of this Title.

(a) All schools under the jurisdiction of the State Education Department shall provide a program of health, physical education and recreation in an environment conducive to healthful living. This program shall include:

  • (1) health and safety education;
  • (2) physical education, including athletics; and
  • (3) recreation.

(a) Provision for health education. It shall be the duty of the trustees and boards of education to provide a satisfactory program in health education in accordance with the needs of pupils in all grades. Such program shall include the several dimensions of health, including mental health and the relation of physical and mental health, and shall be designed to enhance student understanding, attitudes and behaviors that promote health, well-being and human dignity. This program shall include, but shall not be limited to instruction concerning the misuse of alcohol, tobacco and other drugs, and the prevention and detection of certain cancers.
