2.01 The Purpose of These Regulations Is to Set Forth for School Districts the Guidelines to Assure That All Enrolling Kindergarten Students Have a Comprehensive Preschool Examination.

3.00 Definitions

3.01 The "Equivalent" of EPSDT Refers to a Physical Examination Administered by a Licensed Physician or a Registered Nurse Qualified to Conduct Screening Examinations.

4.00 Required Records

4.01 The Arkansas Department of Education Will Disseminate to Districts, Through the Educational Cooperatives, the Student Health Record Folders and Health History Forms.

4.02 Parents Shall Complete a Health History Form Prior to the Physical Examination/assessment.

4.03 The School Will File Each Student's Health History Form in the Student Health Record Folder.

4.04 The School Shall Periodically Update the Student's Record as Additional Medical Data Becomes Available.

4.05 The School Shall Maintain Records Showing the Number of Students Screened, the Number Referred for Treatment or Further Evaluation, Reasons Given for Referral, the Number Seen by a Physician, and the Number Treated.

5.00 Comprehensive and Developmental Preschool Examination

5.01 All Enrolling Kindergarten Students Shall Be Evaluated with the Early, Periodic, Screening, Diagnosis and Treatment (EPSDT) Equivalent.

5.02 The EPSDT or its Equivalent Shall Occur Within Two Years Prior to or Within 90 Days after the Student's Initial Enrollment in Kindergarten.

5.03 If a Child Does Not Attend Kindergarten, the EPSDT or its Equivalent Shall Occur Either Within Two Years Prior to or Within 90 Days after the Student's Initial Enrollment in First Grade.

4.0 VISION SCREENINGS / APPROVED INSTRUMENTS

• 4.01 Beginning with the 2006-2007 school year, all children in pre-kindergarten (PK), kindergarten (K), grades one (1), two (2), four (4), six (6), and eight (8), and all transfer students shall receive an eye and vision screening.

• 4.02 This requirement applies to public schools and charter schools.

• 4.03 Nothing in this act shall preclude voluntary screening of any educational grade or preclude the referral of any child, regardless of grade, whom the teacher or school nurse feels should be screened or examined.

(a) (1)

• (A)
  • (i) Beginning with the 2006-2007 school year, all children in prekindergarten (preK), kindergarten (K), grades one (1), two (2), four (4), six (6), and eight (8) and all transfer students shall receive an eye and vision screening.
  • (ii) This requirement applies to public schools and public charter schools.
  • (B)
  • (i) The Department of Education shall ensure the provision of all general revenues necessary to access federal funds for eye and vision screenings for all qualified federal healthcare program recipients.
  • (ii) The school district shall be responsible for all remaining costs associated with eye and vision screenings.
  • (C) Nothing in this subchapter shall preclude voluntary screening of any educational grade or preclude the referral of any child regardless of grade who the teacher or school nurse feels should be screened or examined. (2) The responsibility for the enforcement of this section rests equally with each school district or public charter school and the parent or guardian of the child

6-18-701. Physical examinations — Individualized healthcare plans.

(c) The physician or nurse appointed under subsection (a) of this section shall make examinations for contagious or infectious disease, including without limitation the teeth and mouth, whenever the examination may be deemed necessary and make examination for other defects at least one (1) time in each school year, preferably at or near the beginning of the year.
