(a) A student with disabilities shall have suitably adapted physical education incorporated as part of the individualized education program developed for the student. Public schools and public charter schools shall provide suitably adapted physical education or supplementary aids for any other student with special needs that preclude the student from participating in regular physical education instruction, as required by section 504 of the Rehabilitation Act of 1973, approved September 26, 1973 (87 Stat. 394; 29 U.S.C. § 794).
District of Columbia Municipal Regulations 3015 Physical Education
3015.1 The LEA shall make physical education services, specially designed if necessary, available to every child with a disability receiving FAPE. 3015.2 Each child with a disability must be afforded the opportunity to participate with non-disabled students in the regular physical education program unless:
- (a) The child is enrolled full time in a separate facility; or
- (b) The child needs specially designed physical education pursuant to the child's IEP. 3015.3 If specially designed physical education is prescribed in the child's IEP, the LEA shall provide the services directly or make arrangements for those services to be provided through an alternative public or private program. 3015.4 The LEA shall ensure that a child with a disability who is enrolled in a separate facility receives appropriate physical education services.
