(12) "School-based health center (SBHC)" means a health center that:

• (a) Is located on school grounds;
• (b) Provides on-site primary and preventive health care, referrals, and follow-up services;
• (c) Could provide on-site dental care or behavioral health care, referrals, and follow-up services; and
• (d) Has been approved by the Maryland State Department of Education (MSDE)

B. Specific requirements for participation in the Program as an SBHC are that a provider shall:

• (1) Be approved by the Maryland State Department of Education (MSDE) as an SBHC;
• (2) Have a written agreement with one of the following enrolled sponsoring agencies:
• (a) Local health department as defined in 45 CFR § 164.501 (Public Health);
• (b) Federally qualified health center as defined in 42 CFR § 405.2400(b); or
• (c) General clinic as defined in 42 CFR § 440.90;

An SBHC, designated by the Department as meeting the criteria specified in Regulation .03 of this chapter, is eligible for reimbursement by the Program for the following services:

A. Comprehensive well-child care, including the administration of vaccines in accordance with the Maryland Healthy Kids Preventive Health Schedule, when:

• (1) Performed by EPSDT certified providers; and
• (2) Rendered according to EPSDT Standard set forth in COMAR 10.09.23.03;

B. Follow-up of positive or abnormal EPSDT screening components without approval of the PCP, except when referral for specialty care is indicated;

C. Comprehensive preventive and primary health services;

D. Family planning services as described in COMAR 10.09.58.05;

E. Covered dental services in accordance with COMAR 10.09.05; and

F. Specialty behavioral health services in accordance with COMAR 10.09.59 and 10.09.80.

A. Each local school system shall provide a coordinated program of pupil services for all students which shall include but not be limited to:

• (1) School counseling;
• (2) Pupil personnel;
• (3) School psychology; and
• (4) Health services.

B. The Pupil Services Program shall focus on the health, personal, interpersonal, academic, and career development of students.

(15) Study school-based health center funding and access issues including:

• (i) Reimbursement of school-based health centers by managed care organizations, insurers, nonprofit health service plans, and health maintenance organizations; and
• (ii) Methods to expand school-based health centers to provide primary care services;

(a) In general. -- There is a Maryland Council on Advancement of School-Based Health Centers in the Department.

(b) Purpose. --The purpose of the Council is to improve the health and educational outcomes of students who receive services from school-based health centers by advancing the integration of school-based health centers into:

• (1) The health care system at the State and local levels; and
• (2) The educational system at the State and local levels.

(a) Duty of county board. -- With the assistance of the county health department, each county board shall provide:

• (1) Adequate school health services;
• (2) Instruction in health education, including the importance of physical activity in maintaining good health; and
• (3) A healthful school environment.

(a) Established. --

• (1) There is a School Health Program.
• (2) The general purpose of the Program is to implement a program in two areas of this State in which portions of the population currently are underserved.
• (3) The Program is designed to:
• (i) Improve the health of school age children in this State; and
• (ii) Provide reports on the performance of the Program.
• (4) Each of the two areas of this State shall be served by separate and equal component parts. One part of the Program will be operated in Baltimore City and the other in Caroline County.

(b) Purposes and objectives. --

• (1) The specific purposes and objectives of the Program operated in Baltimore City are:
• (i) To encourage and promote appropriate and cost effective use of health care services;
• (ii) To reduce unnecessary use of hospital emergency room services;
• (iii) To demonstrate the efficacy of involving parents, students, and community organizations in school health programs, particularly with regard to recruiting and retaining students in school health programs; and
• (iv) To assess whether school health programs could be used as a basis for advising other family members of the student of other sources of primary care.
• (2) The specific purposes and objectives of the Program operated in Caroline County are:
• (i) To concentrate on the early identification, health counseling, and referral for mental health problems to prevent suicides;
• (ii)To assess whether school health programs could be used as a basis for advising other family members of the student of other sources of primary care; and
• (iii) To provide the following health and referral services for students:
• 1. First aid;
• 2. Physical exams and sports physicals;
• 3. Care for minor and chronic illnesses;
• 4. Immunizations;
• 5. Preventive health education services;
• 6. Referrals for counseling at the County Health Department; and
• 7. Social services referrals.

(a) Established. --

• (1) There is a School Health Program.
