(a) The state department shall before July 1, 2010:

• (1) adopt rules under IC 4-22-2 to establish an indoor air quality inspection, evaluation, and employee notification program to assist state agencies in improving indoor air quality; and
• (2) amend 410 IAC 6-5.1 or adopt new rules under IC 4-22-2 to do the following:
• (A) Establish an indoor air quality inspection, evaluation, and parent and employee notification program to assist schools in improving indoor air quality.
• (B) Establish best practices to assure healthful indoor air quality in schools.

In order to maintain good IAQ, the school is responsible for meeting the criteria in this section. During an inspection, the state inspector will investigate any condition that is contributing or could contribute to poor IAQ, including, but not limited to, the following:

• (1) Carbon dioxide levels.

• (2) Humidity.

• (3) Evidence of mold or water damage.

• (4) Excess dust.

(a) Heating facilities shall be capable of and shall be operated to maintain a temperature during periods of student occupancy not less than the following:

• (1) Sixty-eight (68) degrees Fahrenheit (F) in all:

• (A) instructional rooms;

• (B) offices;

• (C) locker rooms; and

• (D) cafeterias.

• (2) Sixty-five (65) degrees Fahrenheit in activity rooms and shops.

• (3) Sixty (60) degrees Fahrenheit in interior toilet rooms.

(b) Where provided air-conditioning systems shall be capable of providing and shall be operated to maintain a temperature not to exceed seventy-eight (78) degrees Fahrenheit and sixty-five percent (65%) relative humidity during periods of student occupancy.

(a) Schools shall establish and maintain a written procedure for routine maintenance of HVAC systems. This procedure shall include, but is not limited to, the following items:

• (1) A schedule for inspecting the HVAC system, including an annual inspection.
• (2) Ensuring that all supply and return air pathways in the ventilation system are unobstructed and perform as required.
• (3) A schedule for cleaning the HVAC coils annually at a minimum.
• (4) A schedule for inspecting and changing filters. This procedure shall be available for the state inspector's review. (b) Schools shall establish and maintain written maintenance logs covering cleaning and filter changes of the HVAC systems for a minimum of three (3) years. These logs shall be available for the state inspector's review. (c) For new construction or renovation of the HVAC system, all air supplies and air returns shall be ducted. Open return plenums above ceilings are not allowed.

(a) Before July 31, 2019, the state department shall distribute a manual of best practices for managing indoor air quality at schools as described in this section. The state department may use a manual on indoor air quality in schools developed by a federal health or environmental agency or another state and make additions or revisions to the manual to make the manual most useful to Indiana schools. The manual must include recommendations for radon testing. The state department shall provide the manual:

• (1) to:
• (A) the legislative council; and
• (B) the department of education; in an electronic format under IC 5-14-6; and
• (2) to the facilities manager and superintendent of each school corporation and the chief administrative officer of each accredited nonpublic school. (b) At least once every three (3) years the department shall:
• (1) review and revise the manual developed under subsection (a) to assure that the manual continues to represent best practices available to schools; and
• (2) distribute the manual to individuals listed in subsection (a)(2).
